Terms & Conditions of Sale
1. Estimates/ Quotations.
All estimates/ quotations are based on the information provided by the customer. Every estimate will clearly outline what material is priced for, what service is included, such as supply only, supply and fit etc…. Granite tops reserves the right to charge for any additional extras, changes requested by the customer or changes to layout originally quoted. These will not be produced until confirmed in writing or by e-mail that the customer is willing to pay the additional for these extras. Any typographical, clerical or other error or omission in any sales literature, quotation, price list, acceptance of offer, invoice or other document or information issued by the Granite Tops shall be subject to correction without any liability on the part of the Granite Tops. Granite Tops reserves the right to change quotations due to increases in material cost if there has been an increase in material cost after 30 days from original quotation.
2. Confirmation of order.
On confirmation of order all details priced for will be confirmed with the client as to what is included in the quotation. Granite Tops reserve the right to change quotations due to but not limited to, increased raw material costs, material availability, etc… Once agreed a 50% booking deposit is required to ensure a spot in our templating schedule. If this is not paid Granite Tops will not carry out the template. When payment is received we will provide you with a date for an onsite survey/ template to be taken. This date can be subject to change. The client is responsible for ensuring the accuracy of all specification and job details during order confirmation to ensure all details are quoted for. All lead times quoted at quotation and booking in stage are approximate and have no binding on the actual template and installation date.
3. Onsite survey/ template.
After confirmation of payment, a date for onsite survey/ template will be agreed. We will send template and installation preparation guides (www.granitetops.ie/guides) to you to read through carefully. Failure to follow these guides may result in a template being rescheduled and will incur a template reschedule fee of €500 and a new template date will be rescheduled in the next available date.
This survey is important so therefore it is necessary that the customer or someone acting on behalf of yourself is present to discuss position of joints, tap holes, overhangs etc… If no one is present to discuss these details and sign off on the job sheet we will send over the job sheet by e-mail to get all details confirmed and signed off on, no job will be put into production until confirmed by email. Occasionally our surveyors will suggest additional work to base units, walls etc… to be carried out to enable us to measure or fit the stone correctly. This work must be carried out before we arrive back for installation.
If not otherwise requested, sink, hob and tap locations will be positioned in the location deemed most suitable by our surveyor. Anything off standard must be requested to our survey staff when on site. Details will not be taken off any plans provided by kitchen companies or architects unless requested by the client via email unless specifically agreed to beforehand.
If the details change after our survey and this requires another on site survey to be taken then an additional charge €500 of will be incurred at the cost of the customer.
If a job is cancelled after template a non-refundable charge of €500 will be taken from the deposit.
4. Fabrication.
After the survey is completed you will receive an auto generated email from our production team. Our production team will be in touch after template to confirm all the details and inform if there is any additional charge or discount. A job card which contains all details will be sent along with a copy of our surveyors drawing. This job card contains all details pertaining to your job. This must be read over carefully and any errors must be notified to our office as this document forms the document required for our factory to produce your job. You have 24 hours from the email to confirm details. No response to the email will be regarded as you agreeing to all details in the email. An installation date will be agreed at this time but this can be subject to change due to unforeseen circumstances such as, but not limited to, natural disasters, machine failure, out of stock material, breakages, changes to template etc…. We will strive to do our utmost to ensure that the original installation date is adhered to. We cannot be held responsible for any delay in the delivery of the countertop. If there are any changes to the delivery date this will be agreed with the client in advance. Once agreed final balance of payment must be received before the job is put into production. Failure to pay the balance in the timeframe given by our production team will result in changes to the installation date.
If any changes are requested 24 hours after our confirmation call/e-mail we cannot guarantee that these will be possible. All changes must be made by email. Requests not made by email will not be accepted. There may be an additional charge for any changes made after 24 hours due to extra machining time, extra material or delays that may be caused to fitting.
5. Installation.
Prior to installation taking place, all kitchen units must be fitted and secured. It is not the responsibility of Granite Tops to make good base units or other areas where stone is required such as but not limited to support needed for shelving. The temporary worktops, window cills (if required), hob, sink, tap and pop up sockets must all be disconnected and removed as outlined in our installation guide (www.granitetops.ie/guides). This is the responsibility of the client to ensure all plumbing and electrical work is carried out before installation and not of Granite Tops. We do not accept any responsibility for any delays caused by other trades people and reserve the right to charge for additional call backs to finish off installation. It is not the responsibility of Granite tops to re-connect these appliances. On completion of the installation the area of the counters will be cleaned and re-sealed (if needed). Any additional work required to base units or walls suggested by our surveyor must be completed before we arrive back to site. Failure to do so may result in an aborted installation and there will be an additional charge of €500 for a reschedule of fitting date.
At this stage we require someone to be present to sign off on the job completed. After the job is signed off and our fitting team have left any additional work required to be carried out must be notified to our office within 24 hours. Failure to notify our office within this timescale will result in an additional charge. We do not accept any responsibility for damage caused by other trades people. Any repair or replacement work required to be carried out to the stone will occur an additional charge.
6. Payment Terms.
The schedule of payments is outlined on all quotations. No work will be carried out without deposits being received. No credit will be given unless agreed in advance and put in writing and sent to our office. Goods remain the property of Granite Tops until full and final payment has been received and cleared. The time of payment of the price is of the essence: if the Client fails to make any payment on the due date then, interest shall accrue and be payable on the amount unpaid (both before and after any judgement) at the rate prescribed for statutory interest pursuant to the European Communities (Late Payment in Commercial Transactions) Regulations 2002, from time to time, until payment in full is made (a part of a month being treated as a full month for the purpose of calculating interest). Notwithstanding delivery and the passing of risk in the goods, or any other provision of these Conditions, the property will not pass to the Client until Granite Tops has received in cash or cleared funds payment in full for the work and materials supplied and installed all other products agreed to be sold to the Client for which payment is then due(Reservation of title).
7. Controversies/ Complaints/ Issues.
Any complaint which is based on any defect in the quality or the condition of the products or their failure to correspond with the specification should be noted to Granite tops in writing within 7 days. No claims for consequential material damage shall be accepted. If the material supplied in slabs or tiles form or on a supply only basis, material should be inspected on delivery and any defect documented on the delivery docket. No claims will be accepted once the material has undergone fabrication and / or has been installed by a third party. Any dispute arising under or in connection with these Conditions or the sale of the materials / products will be referred to arbitration by a single arbitrator appointed by agreement or (in default) nominated on the application of either party by the President for the time being of the Law Society, in accordance with the rules of the Arbitration Acts, 1980- 1998. 11.2 The Contract shall be governed by the laws of the Republic of Ireland.
8. Materials.
Granite, limestone, quartzite and marble are a natural product so therefore are subject to variations such as veining, shading, colour, pit holes, surface cracks etc…. This is more prominent in the lighter shades of granite and this is why we ask all clients to view and select the exact slab to be used in their job. Failure to do so will result in Granite Tops selecting a slab and manufacturing the job from this material. Any complaints about shading, veining etc… will be null and void.
Goods or extras requested after the job is fitted may not match the original order due to the nature of the material. If slabs are selected or viewed in a third party suppliers yard it is the responsibility of the customer to notify us of this including batch and slab numbers. If the customer fails to do so they will be liable for any extra cost in re-manufacturing the job in the selected material. All jobs priced for are for stocked items unless otherwise specified.
Certain materials are more fragile than others and subsequently could break if sections are too long, Granite Tops reserve the right to place joints in the most suitable location, as the material dictates.
All samples given are only indicative of colour and pattern and may vary from the product installed.
9. Cancellations.
All cancellations must be given with prior notice to Granite Tops via writing or email. If a template has already occurred then the €500 template fee is none refundable. If the fabrication of the job has started then then the full amount minus the installation fee is none refundable.
